Terms of Service

These terms govern your use of Variafy. The short version: pay your subscription on time, follow our Acceptable Use Policy, and we both keep things simple. The long version follows.
About these terms
These terms are the agreement between you ("you", "the user") and Variafy ("we", "us") for use of the variafy.vercel.app website and the API behind it. By creating an account, signing in with Google, or paying for a subscription, you accept this agreement. If you do not agree, do not use the service.
The service
Variafy is a creative-production tool that generates advertising banner images from text prompts, edits existing banners conversationally, and re-composes user-supplied artwork for different platform sizes. The service is offered "as is" — we make no specific promise that any given prompt will produce any specific output, that any given output will pass platform-specific advertising policies, or that the service will be available 100% of the time.
Account responsibilities
You are responsible for keeping your password (or the Google account you sign in with) secure, for everything that happens on your account, and for the truthfulness of any information you give us at signup. If you believe your account has been compromised, change your password and email bejandavid04@gmail.com.
Subscription plans and credits
The service uses a credit-based pricing model: 1 credit = 1 image output. The Free plan grants 10 credits at signup and 10 credits every 30 days while the account is open. Paid plans (Starter, Pro, Agency) grant the credit amounts published on /pricing on a recurring 30-day cycle. Credits do not roll over — each cycle resets your balance to the plan amount; unused credits are forfeited. We deduct credits atomically before each model call; if the model call fails for any reason, the credit is automatically refunded. The credit ledger on /dashboard/usage is the authoritative record of every change to your balance.
Billing, renewals, and cancellation
Paid subscriptions are billed monthly or annually in advance through Stripe Checkout. Your subscription renews automatically at the end of each billing period at the then-current price for your plan, unless you cancel beforehand. You can cancel at any time from /dashboard/usage → Manage billing, which opens the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period: you keep your paid-tier access and credits until that date, then downgrade to Free.
Refunds
We do not offer pro-rated refunds for partial months when you cancel mid-cycle. If you were billed in error (duplicate charge, charge after a cancellation we failed to record, charge for a service outage that lasted more than 24 hours), write to bejandavid04@gmail.com within 30 days of the charge and we will refund through Stripe. EU consumers retain their statutory 14-day right of withdrawal from a digital service contract; that right is forfeit only once you have begun using the service (consuming credits).
Ownership of generated content
You own the outputs you generate with Variafy, to the extent the underlying model providers (OpenAI, Google) allow. You can use generated banners commercially, modify them, and distribute them. You retain all rights to the inputs you provided — your prompts, your uploaded logos, your reference images — and you grant us only the limited license we need to operate the service (store them, send them to the model provider, render them back to you). We claim no ownership over your inputs or outputs and we do not use them to train any model.
Your responsibilities for inputs
You are responsible for the legality of every input you provide — that you own the rights to any image you upload, that you have permission to use any logo or trademark you submit, and that your prompts do not violate our Acceptable Use Policy. If a third party complains that your input infringes their rights, we may remove the content and the resulting outputs without notice; persistent or severe violations terminate your account.
Acceptable use
You must comply with our Acceptable Use Policy at all times. The AUP is incorporated into these terms by reference and lists the categories of content that are off-limits. Violation of the AUP is a material breach of this agreement and can result in immediate suspension or termination of your account without refund.
Availability and changes
We will make a reasonable effort to keep the service running but we offer no specific uptime guarantee. We may change features, retire features, change pricing (with at least 30 days' notice for changes that affect existing subscribers), and route generation calls to different underlying model providers as needed. None of these changes give rise to a refund unless they make the service materially unusable for your purposes for an extended period.
Termination
You can close your account at any time from /settings. We can terminate or suspend your account if you breach these terms, violate the Acceptable Use Policy, fail to pay an invoice, attempt to defraud us, or use the service in a way that exposes us to legal risk. Upon termination, your data enters the recycle bin and is permanently purged after your configured retention window (3, 7, 15, or 30 days). Billing records are retained as long as tax law requires.
Limitation of liability
To the maximum extent permitted by law, Variafy is not liable for indirect, incidental, consequential, or punitive damages arising out of your use of the service — lost profits, lost revenue, lost data, business interruption, reputational harm, or any campaign-performance shortfall. Our total cumulative liability for any claim arising from this agreement is capped at the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred euros. This cap does not limit liability for gross negligence, intentional misconduct, or anything else that cannot be limited under applicable consumer-protection law.
Indemnity
You agree to defend and indemnify Variafy against any third-party claim arising from your inputs (uploaded artwork, prompts, logos you don't own), your outputs (campaigns you run with generated banners that violate platform rules or applicable law), or your breach of these terms or the Acceptable Use Policy.
Governing law
These terms are governed by the law of Romania (the EU jurisdiction Variafy is operated from), without regard to conflict-of-law rules. Disputes that cannot be resolved by direct negotiation will be brought before the competent courts of Romania. EU consumers retain the right to bring claims in the courts of their own country of residence under the EU's consumer-protection rules.
